Case Study | Compromise agreements
A senior manager, who had been selected for redundancy, had been offered a compromise agreement.
We advised our client on the terms and effect of the agreement. We also considered the payment that was being offered to her.
It was clear to us that an appropriate redundancy procedure had been followed, but the redundancy payment had been calculated in a way that potentially discriminated against our client by virtue of her age.
Our client instructed us to negotiate an increased payment.
As a result of our careful and detailed argument, we secured a substantial increase to the payment and agreement was reached. We were also able to negotiate amendments to the wording of the agreement to ensure that our client 's future employment plans were not harmed.
