Case Study | TUPE

A national employer with multiple sites, asked us to advise them following the loss of a cleaning contract.  The operations manager was not sure if there was a transfer of undertaking. The successful replacement company was taking over the work within just a few days. 

By responding quickly to the enquiry by the client, we were able to confirm TUPE did apply and we advised the client about their obligations to inform and consult with their employees and also to provide appropriate information to the incoming contractor. 

Failure by our client to observe its obligation would have exposed it to the risk of claims by the transferring employees and also the incoming contractor!
