The Employment Appeal Tribunal has decided that the band of damages awarded for injury to feelings in discrimination cases should be increased.

Da'Bell v NSPCC

In 2002 the case of Vento v Chief Constable of West Yorkshire Police set out three bands of potential awards for injury to feelings awards.

In this case the EAT has decided, we understand with immediate effect, that the bands should be increased to reflect inflation.

The bands for compensation for injury to feelings awards in discrimination cases will now be:

  • £500 to £6,000 (previously capped at £5,000)
  • £6,000 to £18,000 (previously capped at £15,000)
  • £18,000 to £30,0000 (previously capped at £25,000)
