‘Duty of Candour’ introduced for Care Providers

The introduction of this duty applies to care providers from 1 April 2015.

Duty of Candour

The legislation was introduced for healthcare providers in November 2014 but takes effect from 1 April 2015 and has been introduced to ensure openness and transparency when any notifiable safety incident occurs.

A notifiable incident is any unintended or unexpected incident which occurs when a service user is being treated or cared for, and could result in harm to the service user.

Guidance from the regulatory body, the Care Quality Commission, also describes unintentional and unexpected scenarios which need to be treated as notifiable incidents.

Non compliance with the duty of candour is a criminal offence and is punishable by a fine of £2,500.
